Terms of Service

These Terms of Service ("Terms") govern your access to and use of Datalier, a data labelling and observability platform operated by Concave AI ("Concave AI", "we", "us"). By creating an account you agree to these Terms and to our Privacy Policy.
1. Beta status
Datalier is in active beta. Features may change, be removed, or behave unexpectedly. There is no uptime SLA during beta. We will do our best to communicate breaking changes in advance, but cannot guarantee notice for every change.
2. AI Output provided "as is"
Datalier uses third-party and internally orchestrated machine learning models to generate annotations, labels, segmentations, transcriptions, drift diagnostics, and related outputs ("AI Output"). AI Output is provided as is, without warranty of any kind, express or implied.
Concave AI makes no guarantee as to the accuracy, completeness, precision, recall, or fitness for purpose of any AI Output. Automated labelling is probabilistic and will contain errors.
You are solely responsible for reviewing, verifying, and validating all AI Output before using it to train, evaluate, or deploy any model. Concave AI accepts no liability for decisions, models, or business outcomes derived from AI Output.
Model behaviour may change without notice as underlying providers update their systems.
3. Credits
Credits are prepaid units of platform usage. One credit equals $0.05 USD at list price.
Expiry. Credits expire 12 months from purchase. Trial credits expire 90 days from grant. Expired credits are forfeited and non-refundable.
Non-transferable. Credits may not be sold, transferred, or assigned between accounts.
Consumption. Credits are reserved when a job begins and charged on completion, for whatever was actually processed. Failed jobs release reserved credits in full.
No overage. Jobs exceeding your available balance are refused before execution. Datalier does not extend credit or invoice retrospectively.
No cash value. Credits are a licence to consume services, not a deposit, stored value, or financial instrument.
4. Acceptable use
Your use is governed by our Acceptable Use Policy, incorporated into these Terms. Violation is grounds for immediate suspension without refund.
5. Account terms
One account per person. You must provide accurate details and are responsible for keeping your credentials secure and for all activity under your account.
6. Intellectual property
You own your inputs, your outputs, and your labels — see the ownership clause in our Privacy Policy. Concave AI owns the platform itself: the software, models, and infrastructure that deliver the service.
7. Liability cap
To the maximum extent permitted by law, Concave AI's total liability arising from these Terms or your use of Datalier is limited to the fees you paid in the preceding 12 months.
8. Indemnity
You indemnify Concave AI against claims arising from your data, your use of AI Output, and your violation of these Terms or applicable law.
9. Termination
Either party may terminate with 30 days' notice. Concave AI may terminate immediately for a violation of the Acceptable Use Policy.
10. Changes to these Terms
We will give 30 days' notice of material changes. Continued use after a change takes effect is acceptance of the updated Terms. Where you are logged in, you will be prompted to re-accept before continuing.
